MEETING SCHEDULE
Americas
Regional Meeting
Berninzon,
Loret de Mola & Benavides, Abogados and Lawyers
Associated Worldwide invite you to attend the 2005 Americas
Regional Meeting in Lima, Peru on April 7-9, 2005. We
expect more than 40 representatives of member firms
at the meeting.
The
meeting will be held at the JW Marriott Hotel &
Stellaris Casino, beginning with a Welcome Reception
and Dinner on Thursday, April 7th, followed
by meetings on
Friday, April 8th, from 9:00 am – 5:00 p.m.,
and on Saturday, April 9th, from 8:30-11:30
a.m.

are being taken electronically for the meeting. If you

Asia
Pacific Regional Meeting
May
5-7, 2005 is the date for the LAW Asia Pacific Regional
Meeting in Hong Kong. The meeting, which will be held
at the Mandarin Oriental Hotel, will include a Doing
Business in China presentation with a number of speakers.
The meeting will start with a reception and dinner on
Thursday, May 5, 2005, followed by an all day meeting
on Friday, dinner at the Jumbo Floating Restaurant Friday
evening, and a half day meeting on Saturday. The accompanying
persons will have the opportunity on Friday to go to
Lantau Island to see the Buddha Statue and have a veggie
lunch at the Monastery. The Asia Pacific Meeting will
be followed by optional activities of horseracing on
Saturday afternoon and dinner at the peak on Saturday
evening.

hold June 2-4, 2005 for the LAW European Regional Meeting
in Tallinn, Estonia at the Reval Hotel Olümpia. Additional
details will follow in the next newsletter.

Statute
of Limitations Issue Goes to Arbitrator
Todtman,
Nachamie, Spizz & Johns P.C., the LAW member firm
in New York, submitted the following information about
a case in which the firm represented the defendants:
A
recent state court ruling helped define under what
conditions an arbitrator rather than a judge must
determine whether the statute of limitations has expired
in a dispute arising from a contract with an arbitration
clause. Focusing on the contract's choice-of-law provision,
which did not specifically state that New York law
would apply to the "enforcement" of the contract but
only to its terms, Justice Herman Cahn held that the
arbitrator, not the state judge would decide the statute
of limitations issue. The decision, 212 Investment
Corp. v. Myron Kaplan, No. 603029/04, was consistent
with federal laws regarding arbitration.

Buffalo,
NY and Erie, PA Work Together
David
Colligan of Watson, Bennett, Colligan, Johnson &
Schechter, L.L.P., our member in Buffalo, New York,
reports on another LAW success story:
“Another
instance occurred recently when our office was closing
a $9 million US transaction which involved interfacing
with a Philadelphia law firm representing the mezzanine
debt lender who insisted upon some very tough language
in the loan documents. Because the language included
some very specific Pennsylvania law waivers and
penalties, we reached out to David Mosier at the
Knox McLaughlin Gornall & Sennett firm in Erie,
Pennsylvania for some quick advice so that we did
not spend a lot of the time and effort negotiating
over language which may be common under Pennsylvania
law but is somewhat unusual here in New York State.
David read the language in question and gave us
a quick answer as to what parts were negotiable
and what parts were standard under Pennsylvania
practice and how we could best represent our client
considering possible achievable results. It would
have cost our client a great deal of money for us
to negotiate without this type of high quality,
rapid advice and given the time pressures to close
the deal, it no doubt would have made our firm look
bad as holding up the transaction. Sometimes, the
smallest courtesies can be the greatest victories
for organizations such as LAW.”

Structure Advisory Committee
The
Fee Structure Advisory Committee, chaired by Ward
Bondurant of Morris, Manning & Martin, LLP, the
LAW member in Atlanta, GA, has begun its work. The
charge of the committee is to analyze LAW’s existing
fee structure, to compare it to the structures of
other similar organizations, and to explore possible
alternatives.

& Berne On the Move
Ulmer
& Berne LLP, the LAW member firm in Ohio, will be
moving its office, the largest move by a downtown Cleveland
law firm in a decade. The firm will expand its offices
43%. The fast-growing firm can use the space—last year
it added 20 people and this year expects to add 15 more
lawyers. Total Cleveland staff stands at 270. Additional
details will follow when the move takes place. |
