FIDIC Dispute Avoidance Practice Note
The International Federation of Consulting Engineers launched their first Practice Note on Dispute Avoidance, which was co-drafted by Taner Dedezade, Partner at Howard Kennedy, UK. The working group prepared a questionnaire, which was sent out to all members of the FIDIC President’s List, to obtain members’ views on how dispute avoidance works in practice. The key questions put them were as follows:
- How/when does the dispute board make the parties ware of its dispute avoidance role?
- When should dispute avoidance ideally take place?
- Where should dispute avoidance take place?
- What matters most lend themselves to dispute avoidance?
- What are the most effective techniques for dispute avoidance?
