LAW 179/2020 APPROVING  GEO 70/2020 CHANGES REGARDING THE SOCIAL PROTECTION MEASURES IN THE EMPLOYMENT RELATIONSHIPS

CONTEXT

Law no. 179/2020 approving Government Emergency Ordinance no. 70/2020 (“GEO 70/2020”) regulating certain measures, applicable as of 15 May 2020, in the context of the epidemic determined by the spread of the SARS-CoV-2 coronavirus, for extending deadlines, amending and supplementing  Law no. 227/2015 on the Tax Code, National Education Law no. 1/2011, as well as other normative acts (“Law  179/2020”)  was published on 19 August 2020 in the Official Gazette of Romania.

Law 179/2020 will come into force  starting  with 22 August 2020.

SCOPE

Considering that GEO 70/2020 introduced a series of measures for the employers in the context of the epidemic determined by the spread of the SARS-CoV-2 coronavirus, Law 179/2020 brings in amendments relating to individual work schedules implemented by  the employers with a number of employees above 50.

REGULATION

In the previous regulation, under  GEO  70/2020, it was  established that  the employers with a number of employees above 50 had the obligation to establish individual work schedules, without the employee’s consent, so as to ensure a one-hour interval between the employees at the beginning and the termination of the work schedule, over a three-hour period.

Law 179/2020 eliminated the mandatory nature of such measure, regulating the employer’s possibility to establish individual work schedules, so as to ensure a one-hour interval between the employees at the beginning and the termination of the work schedule, over a three-hour period, and the employee should agree with such work schedule.

The individual work schedule and its distribution per days will be established in an addendum to the individual employment agreement.
